Everything said during mediation is strictly confidential and generally may not be discussed with others not involved in the mediation. Statements made during mediation cannot be used in court.
The failure to resolve the dispute in mediation is called an “impasse,” which does not affect any party's ability to continue with litigation.
Typically, the parties share equally the mediator’s fee for services.
